HIPAA Notice

At Garduño Family Medicine, we are committed to protecting the privacy and security of your health information. This Notice of Privacy Practices explains how we may use and disclose your Protected Health Information (PHI) and outlines your rights under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). We are required by law to maintain the privacy of your PHI, to provide you with this notice, and to abide by the terms of this notice.
Uses and Disclosures of Protected Health Information
We may use and disclose your PHI for the following purposes:
- Treatment: To provide, coordinate, or manage your healthcare and related services. This includes sharing information with other healthcare providers, specialists, pharmacies, or laboratories involved in your care.
- Payment: To obtain payment for the services we provide, including sharing information with your insurance company, billing companies, or other payers.
- Healthcare Operations: For business functions necessary to run our practice, such as quality assessment, staff training, accreditation, and compliance reviews.
- Other Permitted and Required Uses and Disclosures: We may also disclose your PHI without your written authorization in certain situations, including:

Any other use or disclosure of your PHI not covered by this notice will only be made with your written authorization, which you may revoke in writing at any time (except where already relied upon).
Your Rights Regarding Your PHI (Protected Health Information)
You have the following rights regarding the health information we maintain about you:
- Right to Inspect and Copy: You may inspect and request a copy of your medical records. Requests must be submitted in writing to our Privacy Officer. A reasonable fee may apply.
- Right to Request Restrictions: You may request limitations on the use or disclosure of your PHI. While we are not required to agree, we will comply if feasible. If you pay out-of-pocket in full for a service, you may request that information not be shared with your insurer.
- Right to Amend: If you believe your PHI is incorrect or incomplete, you may request an amendment. We may deny requests under certain conditions but will provide a written explanation.
- Right to an Accounting of Disclosures: You may request a list of disclosures of your PHI made in the past six years, except for those related to treatment, payment, or operations.
- Right to Request Confidential Communications: You may request that we contact you in a specific way (e.g., only at work or by mail). We will accommodate reasonable requests.
- Right to a Paper Copy: You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.
Changes to This Notice
We reserve the right to change this Notice of Privacy Practices at any time. The revised notice will apply to all PHI we maintain. Any updates will be posted on our website and available upon request.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the U.S. Department of Health and Human Services.

To file a complaint with HHS: Visit www.hhs.gov/hipaa/filing-a-complaint or mail your complaint to the Office for Civil Rights.
We will not retaliate against you for filing a complaint.
